General conditions of Sale

This site (shop.roscioli.com) is owned by Salumeria Roscioli S.r.l. , with registered office in
Rome, via dei Giubbonari, 21-22, registered with the Companies; Register of Rome no.
1199151, VAT number 09947871001, and is dedicated to the retail sale of food and non-food
products.

Roscioli observes the legislation on distance contracts pursuant to art. 45 and following of
Legislative Decree 206/2005 and subsequent amendments.

We invite you to carefully read the general conditions of sale below, which constitute
a binding agreement for the use of the Site, and to print and / or save
them on another durable medium of your choice.

1. GENERAL CONDITIONS

The Conditions applicable to each individual order will be those displayed on the Site at the
time of the order. Any new Conditions will be effective from the moment of publication on the
Site and will apply only to sales concluded after the publication itself.

2. OFFER TO THE PUBLIC

All products and prices indicated on the Site constitute an offer to the public with the
limitations and methods contained on the Site itself and in these Conditions. All products are
also available at the Salumeria Roscioli shop located in Rome, Via dei Giubbonari, 21-22

3. PRODUCTS

The graphics of the delivered products may not coincide with that shown on the Site if the
manufacturer has modified the packaging and, therefore, for reasons beyond the control of
Roscioli. The photos are indicative, the items may undergo variations with respect to the
presentation in the catalog or represent the product already cooked or prepared.

4. PRICES AND PROMOTIONS

Only the price per package calculated at the time of the order will be applied to the
Customers expense, without any consideration of price increases or decreases, even for
promotions, which may have occurred subsequently or previously concluded.
All prices include VAT.
Prices are calculated at the time of the order or at the time of its modification. Discount
coupons and / or vouchers that can be redeemed on subsequent purchases cannot be used for
online shopping. To take advantage of the discount coupons and / or vouchers that can be
redeemed on subsequent purchases, you must go to the Shop.

5. ACCEPTANCE OF ORDERS

The order sent by the Customer will be binding for Roscioli only if the entire order procedure
has been completed regularly and correctly without any indication of error messages by the
Site. Roscioli will not include products not expressly ordered by the Customer in the
shopping.

It is specified that the shopping lists saved by the Customer will be kept for [30] days
following the date of the last modification of the same and therefore automatically deleted.
In the event of excessive requests from customers, Roscioli reserves the right to limit the
number of orders that can be placed by each customer in a given period.

6. CONFIRMATION OF THE ORDER

Following the purchase and only against the regular payment of the price in the manner
provided for in art. 11, in his e-mail box the customer will receive confirmation of the order
delivered with a summary of the products, their prices and the tracking reference of the
courier in charge in order to check the status and delivery times.

7. CANCELLATION AND MODIFICATION OF THE ORDER
In addition to the provisions of point 14), the Customer can modify and cancel the order
within 24 hours of receiving the order confirmation email. Likewise, following unforeseen
logistical and organizational difficulties, he may cancel the order by notifying the Customer
via e-mail or, subject to agreement with the same, modify it. In the event of excessive requests
from customers, Roscioli reserves the right to limit the number of changes to orders already
made.

8. DELIVERY

Roscioli delivers the shopping only in specific areas on the Site and at the time slots provided
by the courier in charge. The delivery service is guaranteed only for homes reachable by the
courier. The staff simply deliver the goods on the landing in front of the front door of the
house. For organizational reasons and service efficiency, the expense cannot be verified or
controlled by the Customer at the time of delivery. For any anomaly found, contact Customer
Service.
Roscioli will not be responsible for any delays occurring during transport. Likewise, Roscioli
cannot be held responsible for any loss, damage, incorrect or non-delivery caused by events
and / or causes of force majeure or unforeseeable circumstances, such as by way of example
but not limited to: natural disasters, adverse weather conditions (such as intense snowfall),
any strikes (by one’s own or other employees), accidents to means of transport, explosions, or
any other similar or different cause. The cost of delivery is not included in the price of the
products.

DELIVERY FACILITIES

a. FREE DELIVERY FOR THE DISABLED

In order to take advantage of the free delivery, the disabled person must have a disease for
which a disability equal to or greater than 60% is recognized. To take advantage of the
benefit, you must fill in the form with the data requested at the following link []delivery and
attach a copy of the appropriate certification from the competent ASL certifying the
percentage of disability (certificate of disability for business use) without indicating the
relative pathology. At the same link, the Customer must also provide consent to the
information for the processing of personal data. Roscioli reserves the right to verify the
continued possession of the requisites for the recognition of the concessions. The benefit can
also be requested by a Client who is a parent of a disabled person who is not of age, or by his /
her guardian, provided that he / she meets the requirements.

b. DISCOUNTED DELIVERY FOR PEOPLE OVER 70 YEARS OLD

The delivery facility is activated automatically at the age of 70 based on the personal data
released when the account is activated. The special rates for the disabled and the elderly are
valid for the forwarding of only one item per month; the standard rate will be applied to
subsequent ones. To verify the limitation, the delivery date of the order is valid.

9. PRODUCTS NOT AVAILABLE AND PURCHASE RESTRICTIONS

Roscioli will not be responsible in any way for the temporary or definitive unavailability of
one or more products. In the event of unavailability, even temporary, of the requested
products, Roscioli undertakes not to charge the Customer the corresponding price. On the site
there are cases in which it is worth highlighting the purchase of individual products.

10. NON DELIVERY

For delivery, the presence of the Customer or his representative is required at the address
indicated in the order and at the time communicated by the delivery courier. If the Customer
(or the person in charge) is not present, the order is considered canceled and the Customer
will be charged (as a penalty, also on the subsequent expense) the cost of delivery and that of
the products ordered. In this case, therefore, the Customer will not be entitled to a refund of
the price for the order placed.

The purchase can be paid by the Customer only online through:
A. Credit, debit and prepaid cards enabled for online payments on the MasterCard, Visa,
American Express circuits.
B. Paypal
C. Stripe

Payment will be made upon confirmation of the purchase order. Except for the hypothesis
provided for in art. 7 and 13 refunds and / or returns, even if only partial of the price, are not
possible. Cash payments are not accepted.

12. INVOICE

The issuance of the invoice is not mandatory, if it is not requested by the Customer no later
than the time of placing the order as indicated in the Presidential Decree of 26/10/1972 n.
633 – Article 22, by express mention in the "Notes" section.

13. RIGHT OF WITHDRAWAL
The Customer’s rights are protected by Legislative Decree 206/2005 and subsequent
amendments. The Customer therefore has the right to withdraw from the contract, even
partially, without explanation and without additional costs, provided that the withdrawal is
communicated by registered letter with return receipt. R to Roscioli – E-commerce Customer
Service, or via certified e-mail (pec) within 14 working days from the day of receipt of the
products. The communication can be anticipated, within the same term, by e-mail, fax or telegram,
provided that it is confirmed by registered letter with return receipt or
certified e-mail within the following 48 hours.
This communication must specify the intention to withdraw from the purchase and the product
or products for which the right of withdrawal is to be exercised, attaching a copy of the receipt.
The Customer must then return the product to the Store at his own expense.
If the withdrawal has been exercised in accordance with the concession procedures, Roscioli
will refund the amount paid for the purchase of the product within 14 days from the date on
which Roscioli became aware of the Customer’s exercise of the right of withdrawal. The refunded
amount will be net of delivery costs.
The customer will be responsible for the condition of value of the returned goods resulting from
a provision other than that necessary for the nature, characteristics and functioning of the goods.

Without prejudice to the above, the right of withdrawal is not allowed in the case of:
A. purchase of sealed packaged products, opened by the Customer;
B. of goods made to measure or personalized (eg gastronomy products);
C. of goods which by their nature cannot be returned or are liable to deteriorate or expire
rapidly (eg perishable food products or gastronomy products);
D. virtual products (by way of example and not limited to: voucher or gift card)

14. SUSPENSION OF THE SERVICE

In the event of serious breaches by the Customer (by way of example but not limited to: f
ailure to pay the shopping without the need for the Customer at the time of delivery of the shopping,
non-use of the shopping procedure), Roscioli, after written communication to the Customer,
reserves the right to suspend the service.

15. LIABILITY

Roscioli guarantees compliance, in general, with the quality standards relating to products (in
particular foodstuffs) up to the time of delivery to the courier in charge of delivery to the
Customer; any liability relating to the bad condition of the products due to improper storage
after delivery is excluded. Roscioli declines all responsibility for direct or indirect damages of
any nature or in whatever form they occur, resulting from the use of the Site and / or the
news, photos and information contained therein. Roscioli assumes no responsibility for the
information provided / acquired by individual manufacturers or distributors.

16. PRIVACY
Roscioli will process the Customer’s personal data in compliance with the privacy legislation
as specified in detail in the information issued at the time of account activation.

7. JURISDICTION

Any and all controversy that should arise in relation to the application, interpretation and
execution of these Conditions, will be strictly devolved to the judge of the place of residence
or domicile of the consumer, if located in the territory of the State.
